The Latice Association concluded a Contract on the provision of social services of personal assistance on December 15, 2023 and began providing the same on January 1, 2024.
EXERCISE OF RIGHTS TO THE SERVICE:
1) Personal assistance services provided by a personal assistant, for which the need for assistance has been assessed based on the Needs Assessment List, can be provided by a person with a disability for a period of 44 to 352 hours per month, or 10 to 80 hours per week.
(2) The hourly rate for personal assistance services provided by a personal assistant is classified according to the needs of the user as follows:
– a personal assistance service provided by a personal assistant for up to 352 hours per month can be provided to a single person with a 4th degree physical disability who has a Barthel index of 0 – 20
– personal assistance services provided by a personal assistant for up to 176 hours per month can be provided by:
1. a person with a 4th degree physical disability who has a Barthel index of 0 – 20
2. a person with a 4th degree physical disability who has a Barthel index of 21 – 35 and who lives alone or the other household members are minors
3. single man with 4th degree mental impairment
– personal assistance services provided by a personal assistant for up to 88 hours per month can be provided by:
1. a person with a 4th degree physical disability who has a Barthel index of 21 – 35
2. a person with a 3rd degree physical disability who has a Barthel index of 36 – 45
3. person with intellectual disability of the 3rd and 4th degree
4. people with autism spectrum disorders 3rd and 4th degree
5. a person with a 4th degree mental disability who lives in a family
6. single person with 3rd degree mental impairment or
7. single man with chronic diseases of the 4th degree.
(3) By way of derogation from paragraph 2 of this Article, a person referred to in paragraph 2, subparagraphs 1 and 2 of this Article, who has been granted full-time residential care for more than three days a week pursuant to the law regulating social welfare activities, is entitled to a maximum of 88 hours per month of personal assistance services provided by a personal assistant.
(4) By way of exception to paragraphs 1 and 2 of this Article, a person referred to in paragraph 2 of this Article whose parent or other family member has a recognized right to the status of a parent-carer or the status of a carer for the need to care for him or her pursuant to the law regulating social welfare activities may exercise the right to personal assistance services for up to 88 hours per month if:
- lives with a single parent
– lives in a single-parent family
– lives in a two-person household
– lives in a household with two or more disabled people or
– is completely dependent on the help and care of another person because, in order to maintain life, she needs specific care by performing medical and technical procedures for which, according to a doctor's recommendation, the parent caregiver or caregiver is qualified, and who cannot participate in community programs due to her health condition.
(5) By way of exception to paragraphs 1 and 2 of this Article, a person referred to in paragraph 2 of this Article whose parent or other family member has a recognised right to the status of a carer parent or the status of a carer for the purpose of caring for him or her pursuant to the law regulating social welfare activities may exercise the right to a maximum of 44 hours of personal assistance services per month if he or she lives in a household in which the spouse or common-law partner of the carer parent is absent from the place of residence for more than six months per year due to work obligations.
(6) By way of exception to paragraphs 4 and 5 of this Article, a person whose parent or other family member has a recognized right to the status of a parent-carer or the status of a carer for the purpose of caring for him or her pursuant to the law regulating social welfare activities, and who has the status of a student, may exercise the right to the service of personal assistance in accordance with the hourly rate prescribed in paragraphs 1 and 2 of this Article.
